Yes, vaping is legal in the UAE. Is vaping legal in the UAE?
Vaping is legal across all seven emirates. Before April 2019 the market was unregulated and most products were effectively prohibited; that changed when standard UAE.S 5030:2018 was introduced, legalising the sale, import and use of e-cigarettes, electronic shisha devices and e-liquids that meet UAE requirements.
Disposable vapes, refillable pods and larger kits are all sold legally, provided they are certified and compliant. Legal, however, does not mean unrestricted — the framework works a lot like the rules around smoking.
Who regulates vaping in the UAE?
A few authorities share oversight:
- The Ministry of Industry and Advanced Technology (MoIAT) sets the technical standards and runs ECAS certification (this role moved across from ESMA in 2020).
- The Ministry of Health and Prevention (MOHAP) oversees the sale, possession and use of vape products.
- The Federal Tax Authority (FTA) handles excise tax and the digital tax stamps that track genuine stock.
- Local authorities in each emirate enforce public-use rules under the national tobacco law.
What makes a vape legal to sell?
To be sold legally in the UAE, a vape has to clear several requirements under UAE.S 5030:2018:

The 20 mg/ml nicotine cap explained
The single most important e-liquid rule is the nicotine ceiling: 20 mg/ml, which is the same as 2%. Any product above that is illegal for domestic sale, which is why the 5% (50 mg) devices sold in some other countries are not permitted here. What is not allowed
Some things stay firmly off-limits:
- THC or CBD e-liquids and cartridges of any strength — treated as controlled substances under federal drug law.
- Any product over the 20 mg/ml nicotine cap, or pods over the capacity limits.
- Homemade, modified or DIY-mixed e-liquids.
- Uncertified products with no ECAS mark or proper bilingual labelling.
Where can you vape in the UAE?
Public vaping follows the same framework as cigarette smoking. That generally means no vaping in indoor public places, malls, offices, restaurants and cafes except in designated smoking areas, and no vaping on public transport or near government and religious sites. Vaping in prohibited areas can bring fines or confiscation of your device.
One rule deserves special attention: it is illegal to smoke or vape in a vehicle carrying a child under 12, under UAE child-protection and tobacco-control law. When in doubt, treat vaping exactly as you would a cigarette.
